AI Regulation in EU: the AI Act

 

Artificial intelligence (AI) has undergone rapid advancements, particularly in recent years. Recognizing the potential risks and opportunities presented by AI, the European Commission has identified the need for a unified regulatory framework across Europe. The objective is to establish a consistent legal structure that balances the benefits of AI with the risks it may pose. This framework aims to safeguard fundamental rights, protect users, and provide legal clarity for the rapidly evolving AI landscape.

Risk-Based Classification

The new regulatory framework adopts a risk-based approach, meaning that AI regulations will be tailored according to the level of risk associated with a given system. AI applications that present an unacceptable risk to human safety will be strictly prohibited. This includes AI systems that employ subliminal manipulation, exploit human vulnerabilities, or facilitate social scoring—where individuals are assessed based on their social behavior, socioeconomic status, or personal characteristics.

The legislation categorizes AI risks into four levels, based on the potential harm they may cause in different use cases:

  1. Minimal Risk – AI applications with negligible risk can be freely used with minimal restrictions.
  2. Limited Risk – Systems that pose specific transparency risks (e.g., biometric categorization or emotion recognition) require user disclosure.
  3. High Risk – AI systems that could significantly impact health, safety, fundamental rights, or the environment must comply with strict requirements before market approval.
  4. Unacceptable Risk – AI applications deemed too dangerous, such as those that manipulate human behavior or pose security threats, are banned outright.

High-Risk AI Systems

In the latest compromise proposal from May 2023, Members of the European Parliament expanded the definition of high-risk AI systems to include technologies that could threaten health, safety, human rights, or the environment. Additionally, AI systems used to influence voter behavior in political campaigns and recommendation algorithms employed by large social media platforms (with over 45 million users, as defined in the Digital Services Act) have been classified as high-risk.

Enforcement and Penalties

Companies that violate AI regulations will face strict penalties. The fines are structured as follows:

  • €35 million or 7% of global annual turnover (whichever is higher) for using prohibited AI applications.
  • €15 million or 3% of global annual turnover for breaching other regulatory obligations.
  • €7.5 million or 1% of global annual turnover for providing false or misleading information.

To ensure fairness, proportionate fine caps will be applied to small and medium-sized enterprises (SMEs) and startups.

Regulation of General-Purpose AI

The AI Act introduces specific rules for general-purpose AI models to enhance transparency throughout the AI value chain. For highly capable AI models that could pose systemic risks, additional binding requirements will be implemented, including risk management and incident monitoring. These new obligations will be enforced through industry-developed codes of conduct, created in collaboration with academia, civil society, and the European Commission.
